Senate President, Dr. Abubakar Bukola Saraki, led the Principal Officers into the chambers; took the official prayers; and began the day’s proceedings at 10:54am.
EXECUTIVE SESSION
Senate moved into an Executive Session at 10:58am and resumed at 11:52am.
Senate President, Dr. Abubakar Bukola Saraki reported that at the Executive Session the Senate deliberated on topical national issues and the workings of the National Assembly in general.

The Senate President, Dr. Abubakar Bukola Saraki welcomed Distinguished Senators and delivered his opening remarks
“Distinguished colleagues, I welcome you all back to the Senate Chambers after the short recess.”
“I trust that the break has afforded each and every one of us the opportunity to cast our minds back over the last three years, to take stock and assess our performance thus far, and to better plot the way forward as we embark on the last lap of the 8th Senate.”- Senate President, Dr. Abubakar Bukola Saraki.
“As you all know, this Senate clocked its third anniversary while we were on break; and, given the sombre mood of the nation, there was no great celebration.”- Senate President, Dr. Abubakar Bukola Saraki.
“Nonetheless, we had occasion to get an overview of the considerable achievements of this Senate since its inauguration on June 9, 2015. Indeed, we have come a long way, and have set a new bar in the legislative history of this country.”- Senate President, Dr. Abubakar Bukola Saraki.
“We have passed 213 Bills in the period under review and cleared 138 Petitions – surpassing in three years the records of the entire four-year terms of every previous Senate. This is no mean feat. As we hit the home run, therefore, it is important we do not pack-pedal or slow down; we must intensify efforts towards doing all that we are sworn to do for the electorate that voted for us as their representatives.”- Senate President, Dr. Abubakar Bukola Saraki.
“Distinguished colleagues, you will agree with me when I say that the 8th Senate’s achievements would not have been possible without the support of Nigerians.”- Senate President, Dr. Abubakar Bukola Saraki.
“They gave us the mandate and they trusted us to deliver; the people’s confidence in us has been a boon to all our endeavours in this hallowed chamber, and has put a spring in our steps with regard to all legislative activities.”- Senate President, Dr. Abubakar Bukola Saraki.
“With the backing of the people, we have been able to introduce landmark legislations that have helped boost our recovering economy.”- Senate President, Dr. Abubakar Bukola Saraki.
“These include: the Companies and Allied Matters Act (CAMA), which is the most significant business reform Bill in Nigeria in nearly three decades.”- Senate President, Dr. Abubakar Bukola Saraki.
“As a result of the signing into law of the Secured Transactions in Movable Assets Act and the Credit Bureau Reporting Act, for instance, Nigeria was upgraded on the World Bank’s annual Ease of Doing Business ranking.”- Senate President, Dr. Abubakar Bukola Saraki.
“This has been a very welcome development for our economy and for restoring investor confidence in our business terrain. Other landmark economic Bills include: the Warehouse Receipts Bill, the Nigerian Railways Authority Bill, and the National Transportation Commission Bill.”- Senate President, Dr. Abubakar Bukola Saraki.
“We have given tremendous support to the fight against corruption with the passage of Bills such as: the Mutual Assistance in Criminal Matters Bill, the Witness Protection Bill, the Whistleblower Protection Bill and the Federal Audit Service Commission Bill.”- Senate President, Dr. Abubakar Bukola Saraki.
“You will recall that it was the quick intervention of the 8th National Assembly – through the passage of the Nigerian Financial Intelligence Unit Bill (NFIU) - that saved Nigeria from being expelled from the global community of the Egmont Group.”- Senate President, Dr. Abubakar Bukola Saraki.
“It was in the life of this Senate that we finally ‘split the atom’ of the once intractable Petroleum Industry Bill (PIB), after almost two decades in the legislative wilderness. We split the Bill into four manageable parts; and, not only have we passed the first of those, the Petroleum Industry Governance Bill (PIGB), we have started work on the remaining three – the Administrative, Fiscal and Host Communities components of the Bill and have already taken them up to Public Hearing stage.”- Senate President, Dr. Abubakar Bukola Saraki.
“The clock is ticking and we must ensure that we conclude work on the remaining PIB Bills as soon as possible. Nigerians deserve no less.”- Senate President, Dr. Abubakar Bukola Saraki.
“Our many interventions over the last three years, have shown that we are a Senate that is responsive to the needs of the people. This is observable in the constitutional amendment Bills that we have passed.”- Senate President, Dr. Abubakar Bukola Saraki.
“Notable among these is the #NotTooYoungToRun Bill, which received Presidential assent on May 31, 2018, to wild jubilation around the country, due to the momentous generational shift it is expected to trigger in national leadership, in paving the way for the greater participation of youths in governance.”- Senate President, Dr. Abubakar Bukola Saraki.
“A youth-oriented focus has similarly informed our engagement with relevant organisations on youth development and empowerment, in order to create jobs that will usefully occupy our teeming youths. We should be rightly proud of the milestones we have reached in this regard, because as we all know, youth inclusiveness is key to sustainable democratic governance.”- Senate President, Dr. Abubakar Bukola Saraki.
“As a people-oriented Senate, we have made major interventions on the drug abuse epidemic afflicting our communities, especially the youth demographic. In so doing, we have helped spark a national debate about drug abuse that is now the subject of major media attention.”- Senate President, Dr. Abubakar Bukola Saraki.
“Additionally, we have drafted two Bills to tackle the problem, namely the Drug Control Bill and the Mental Health Bill. It is now incumbent on us to introduce these Bills and for the legislative process on the two to begin without delay, following their review by the relevant Civil Society Organisations and other stakeholders.”- Senate President, Dr. Abubakar Bukola Saraki.
“Among our most transformative achievements, my distinguished colleagues, is the step we have taken to make healthcare a right of Nigerians, and to put it within the reach of our entire population of 180 million people.”- Senate President, Dr. Abubakar Bukola Saraki.
“This we have done through the setting aside of 1% of the Consolidated Revenue Fund (CRF) to establish the Basic Healthcare Fund in the just concluded 2018 Budget. This is grounded in our belief that all Nigerians, no matter their economic status, deserve access to qualitative and affordable healthcare, to make for a stronger Nigeria with healthy and vibrant citizens who will, in turn, drive the country’s growth and development.”- Senate President, Dr. Abubakar Bukola Saraki.
“Distinguished colleagues, the foregoing represents something of a recap of the journey so far, and also, in a sense, maps out the challenges ahead of us, which we must face head on. We are resuming plenary today under a pall of national anxiety and apprehension over the state of insecurity in the country.”- Senate President, Dr. Abubakar Bukola Saraki.
“We have been alarmed at so many senseless killings of Nigerians, with the high number of casualties in Plateau being among the most egregious of late.”- Senate President, Dr. Abubakar Bukola Saraki.
“In the wake of the atrocity, I led a Senate delegation to pay a condolence visit to the Governor of Plateau State, and to commiserate with the people of the state. As always, our sympathies are with those who have lost loved ones in these acts of barbarity, and we reaffirm our commitment to ensuring peace and security in our country.”- Senate President, Dr. Abubakar Bukola Saraki.
“As you all know, we held a Security Summit some months back, specifically to address the rising insecurity and to work out strategies in collaboration with security agencies on safeguarding Nigerian lives.”- Senate President, Dr. Abubakar Bukola Saraki.
“Furthermore, we set up the Ad-Hoc Committee on the Review of Security Infrastructure in Nigeria, chaired by Senate Leader Ahmed Lawan; and we must now take steps to consider the Report of that committee and take forward the recommendations therein as may be appropriate.”- Senate President, Dr. Abubakar Bukola Saraki.
“Events have shown that we were right to take these steps in response to the security challenges facing the nation at this time.”- Senate President, Dr. Abubakar Bukola Saraki.
“Let me reassure Nigerians that we are as concerned as they are in the face of this challenge; and we continue to hold government accountable, in order to see to improvement in this area.”- Senate President, Dr. Abubakar Bukola Saraki.
“In addition to the Security Summit earlier mentioned, we held briefings with Security Chiefs in a bid to better understand the problems; and have urged them to table their requests for more funds, so that the legislature can work on that aspect as well, to better equip the security forces to protect lives and property.”- Senate President, Dr. Abubakar Bukola Saraki.
“Through our oversight functions, we can ensure the proper utilisation of such funds and see to it that we have full accountability in the management of the current security crisis.”- Senate President, Dr. Abubakar Bukola Saraki.
“I must say, once again, that the responsibility for ensuring security rests with each and every one of us. Issues of criminality are involved in these heinous acts, and the vigilance of community leaders and the average citizen is crucial, to assist the security agencies do their job.”- Senate President, Dr. Abubakar Bukola Saraki.
“For us as the Senate, it does seem that these issues are also an indication that it is time to revisit the issue of State Police; and to devise a framework for the mopping up of the 350 million pieces of light weapons estimated to be in circulation within our borders – an alarming ratio of three weapons to one person.”- Senate President, Dr. Abubakar Bukola Saraki.
“Meanwhile, let me use this opportunity to call for calm on all sides. We have called many times for unity and tolerance, and we must remind ourselves of the imperative of peace at this difficult time in our nation.”- Senate President, Dr. Abubakar Bukola Saraki.
“Moderation is needed in our speech and in our actions as responsible citizens, even in what may be deemed as provocative situations. We must therefore, all of us, be careful of speech that has the potential to heat up the polity and heighten tensions. We implore the media also to exercise great responsibility in their reporting; Fake News can lead to dire consequences that we can ill afford. Nigeria is the only country we have.”- Senate President, Dr. Abubakar Bukola Saraki.
“Distinguished colleagues, it is clear that internal tensions are also a reflection of the economic condition of the citizenry. We will therefore be calling on all stakeholders to put Economic Bills on the fast lane in order that we may conclude them, so that we can open the door to greater opportunities for our people.”- Senate President, Dr. Abubakar Bukola Saraki.
“Growth and development can only serve to deepen our democracy. To this end, I call on Committees that have not reported on their various mandates to quickly do so, so that we can conclude work on outstanding Bills intended to create economic prosperity for Nigerians.”- Senate President, Dr. Abubakar Bukola Saraki.
“Happily, the 2018 Budget has been signed by the President. We call on the Executive to expedite the release of funds for Budget implementation, so that our people can begin to see the positive impact in their lives without delay. The work is not done.”- Senate President, Dr. Abubakar Bukola Saraki.
“We as the Senate must continue to exercise our oversight functions to ensure successful implementation and value for money. Naturally, we continue to work towards reforming the budgetary process.”- Senate President, Dr. Abubakar Bukola Saraki.
“Clearly, it is necessary for the Executive and the Legislature to work towards a more robust engagement on the need for a better budget environment and process, going forward.”- Senate President, Dr. Abubakar Bukola Saraki.
“In closing, my distinguished colleagues, let us maintain the standard that we have set for this historic 8th Senate. The remaining work on the Constitutional Review process, pending concurrence issues and – unconcluded Bills especially the three PIB components outstanding as well as the earmarked economic Bills – all these demand our urgent attention.”- Senate President, Dr. Abubakar Bukola Saraki.
“As we inch closer to the 2019 electioneering period, I urge us not to lose focus. The divided attention of the legislature is not in the interest of the country. We must not be distracted. It is incumbent on us, therefore, to not allow politicking get in the way of our first duty to the Nigerian people, as Senators of the Federal Republic.”- Senate President, Dr. Abubakar Bukola Saraki.

POINT OF ORDER
Senator Barnabas Gemade cited Orders 42 and 52, spoke on a national issue of great importance, informing the Senate on the presence of a large number of luxurious buses parked outside NASS with Nigerian youths standing outside and protesting constituency projects in the budget.
"It is clear that whoever is behind this has little knowledge of constituency projects."- Senator Barnabas Gemade.
“I second the motion, these people are mainly unemployed individuals who resort to protests in the city after being paid as little as N500.”- Deputy Senate President, Ike Ekweremadu.
“Seeing these people makes me very sad for this nation because they are protesting for what they do not believe in. I challenge anyone contradicting these projects to come forward."- Deputy Senate President, Ike Ekweremadu
“I support the motion, this protest is an attempt by some group of people to set the people of Nigeria against the National Assembly. These constituency projects, started by former President Yar' Adua are effective and anyone fighting it is ignorant and against this nation."- Senator Atai Aidoko.
“Nigerians need to educated on what constituency projects are."- Senator Kabir Marafa
“The only projects found in most constituencies are the constituency projects. That being said, these people are simply hired protesters and not from various state constituencies."- Senator Obinna Ogba
“Because of the size of this nation, the decision for these constituency projects was a necessity. Through these projects the Senate has contributed immensly to the growth of Nigeria. This conduct is unbecoming of any well-meaning Nigerian."- Senator Bala Na’allah
“There is poverty in the nation and as such, these people are only doing what they have been paid to do in order to feed themselves. These projects are laudable because as you build these constituencies, you build the nation."- Senator Mao Ohuabunwa
"I use this opportunity to ask the Federal Government to create more jobs because if you can get free labour now, during elections you will find these same people doing dirty jobs to hamper the elections."- Senator Mao Ohuabunwa
"First of all, my constituency is very grateful to the Senate President, Dr. Abubakar Bukola Saraki. People are not even aware that these constituency projects are not done by Senators.”- Senator Godswill Akpabio
“It is the Executive arm that gives out these jobs, the Senate simply suggests. These protests are the height of ignorance. That being said, i would like to suggest that committees be assigned to various Senators to commission these projects."- Senator Godswill Akpabio
Senate resolved that:
The Senate do continue the well thought-out constituency projects in all constituencies of the Federal Republic of Nigeria.
“It is important that we continue to educate the public on the importance of these Constituency Projects and also to correct any misinformation that these constituency projects funds are coming into the hands of lawmakers.”- Senate President, Dr. Abubakar Bukola Saraki.
“These are only projects that are facilitated by lawmakers to ensure that there is a federal project in every part of the country. Before now, there have been no other measures to ensure that there is an equitable distribution of projects in the country.”- Senate President, Dr. Abubakar Bukola Saraki.
“Therefore, constituency projects are aimed at ensuring unity, equity and justice because for as long as you have any constituency where you cannot find federal projects, then there is injustice and corruption in the country.”- Senate President, Dr. Abubakar Bukola Saraki.
“How can you justify the fact that certain constituencies do not have federal projects? We spend N2trillion every year on capital projects, and these constituencies are a part of this country, yet, they do not have any project at all. Having these sort of constituencies could lead to a sense of disunity.”- Senate President, Dr. Abubakar Bukola Saraki.
“This is why the Nigerians that are being used [for the protest], they should understand that people are just taking advantage of the problems in the country, and what is sad about it is that those who are doing this, are those who are part of government. This does not help the unity or the harmony of the three arms of government.”- Senate President, Dr. Abubakar Bukola Saraki.
“I think that Mr. President needs to investigate this and call to order those involved. There is no secret in this. If you go out there, those boys will tell you who the Minister or the Governor they are collecting the money from. “Hence, I really do not understand how people will promote unity with these sorts of things. There is a need for these kind of activities to stop, it does not help that today you are talking about the 8th Senate or the 8th House of Representatives, and you continue to weaken these institutions. “It is very important that those that are showing rascality and irresponsibility should be called to order, because they are just taking advantage of these young boys.”- Senate President, Dr. Abubakar Bukola Saraki.
“Today, you call them to come and protest against constituency projects. The day that somebody pays them to come and protest against this same democracy could happen.”- Senate President, Dr. Abubakar Bukola Saraki.
“If people have scores to settle, they should find other ways. Not using youth who are unemployed to fight against causes that do not make any sense.”- Senate President, Dr. Abubakar Bukola Saraki.
“If there is something wrong with the implementation of constituency projects, it is the executive. They award the contracts. They release the money. So, if there is a problem, they should go and protest at the ministries. We do not award the contracts and we surely do not release the money for the contracts.”- Senate President, Dr. Abubakar Bukola Saraki.
“Those who are behind these kinds of protests should desist. We know who you are. This does not help the country in any way.”- Senate President, Dr. Abubakar Bukola Saraki.
Senator Jonah Jang cited Orders 42 and 52, stated that there were attacks on various villages, presents the security challenges in Plateau North Senatorial District, a good number of people died and many others injured.
Senator Joshua Lidani seconded the motion.
"People are becoming insensitive to these killings. Something must be wrong with the security apparatus because no culprits are being apprehended.
“We need to think of ways of doing something dramatic like getting the entire Senate to visit affected states so as to demonstrate our concern for the people."- Senator Joshua Lidani.
“I would like to use this opportunity to extend my condolences to the people of Plateau State. What happened in Plateau has happened in so many parts of Nigeria, this means that no one is safe. We have to show sufficient concern and deal with this.”- Deputy Senate President, Ike Ekweremadu.
“The fact is the Federal Government does not have enough manpower to fight these attacks. This is unfortunate. I want to thank SP and ask for provision to be made for State Police. We have to come up with initiatives to deal with this.”- Deputy Senate President, Ike Ekweremadu.
“Each state of this Federation needs to have a sufficient number of police available to tackle this issue as it has become an international embarrassment."-Deputy Senate President, Ike Ekweremadu.
“I lost someone who worked very closely to me who was like a son to me in this crisis. Something needs to be done about the killings in Jos. Anyone passing through could be a victim."- Senator Adamu Aliero.
“If we don't tackle this issue, we will wake up one day and see everything out of control. Anybody can be a victim of these crises. We need to try and communicate and do the right thing."- Senator Isah Misau.
“The security men know the perpetrators and yet they keep silent. An individual came forward on social media and called the killings a reprisal attack for the theft of their cows. Are human lives not more important than cows?”- Senator Philip Gyunka.
“These people have not even been arrested after these claims. Nothing is being done in that regard. Helpless people were killed and this is all uncalled for. The military capacity is in only thousands compared to the millions of citizens in the nation. We as the Legislative arm must come up with a solution. Posterity will judge us.”- Senator Philip Gyunka.
“What happened in Plateau State is unacceptable. I believe that this issue has united both the Executive and Legislative arm in this respect. Senate President, Dr. Abubakar Bukola Saraki visited Plateau and looked into the possibility of sustainable solutions to what happened in the state.”- Senator Ahmad Lawan.
“Our resolutions on this issue will surely be respected. The security is not yielding desired results. The time has come to reform the security architecture of the country as time is of the essence here. We cannot afford to have anymore loss of lives. This Administration must ensure that something is done to ensure that what happened in Plateau State is accounted for."- Senator Ahmad Lawan.
“I wish to extend my condolences to the people of Plateau on the gruesome murder of hundreds of people."- Senator Godswill Akpabio.
“What baffles me is that there is a whole battalion stationed in Jos and so many security stations are there, yet these killings persist. Something has to give. If the world thinks Nigeria is unsafe, we will be affected in many areas in this nation.”- Senator Suleiman Adokwe.
“The first duty of any government is to protect lives and property. Time has come for us to make clear markings of how to deal with this issue."- Senator Suleiman Adokwe.
“I commend Senate President, Dr. Abubakar Bukola Saraki and Senate Leader on taking the initiative to find solutions for this issue. The creation of State Police is necessary. What happened in Plateau is only the tip of the iceberg of things to come."- Senator Adeola Solomon.
“Let us deal with this problem once and for all. This cannot be done by constant deniability on the part of the Executive. Unless we take responsibility as a nation for the offices we hold.”- Senator Barnabas Gemade.
“We need to take action and those who will not do so must be shown the way out. We as legislatives must call for the amendment of the constitution to deal with the situation in one fell swoop."- Senator Barnabas Gemade.
“Even more condemnable in all this is the attitude of the Plateau people when these killings happen. What is happening in Nigeria is an issue we need to open our eyes and tackle this.”- Senator Kabir Marafa.
“This is not a religious issue as there have also been many killings in Zamfara that were only mentioned in passing."- Senator Kabir Marafa.
“It is clear that we have talked about the fact that whether these killings were initial acts of aggression or reprisal attacks, it is clear that either way, it is totally unacceptable and we must condemn it in all totality.”- Senate President, Dr. Abubakar Bukola Saraki.
“Secondly, these are acts of criminality and we should not encourage any other colouration to it, be it religious or otherwise. This is criminality. And as such, we have a role to ensure that we must address this criminality to see how we can fight it.”- Senate President, Dr. Abubakar Bukola Saraki.
“We have spoken on many platforms and made suggestions to the Executive on the fact that there is a need for an urgent review of the security architecture of the nation.”- Senate President, Dr. Abubakar Bukola Saraki.
“The debate in the British House of Lords also raises this point: “How do we think this would affect our economy and investments if we continue to have this kind of security climate?” We must see this issue of insecurity not only from the point of view that there is danger and insecurity, but there is also a danger to our economy — especially if we want to grow our economy.”- Senate President, Dr. Abubakar Bukola Saraki.
“We as the Senate must come up with our own actions. We do not need to flog the issue. We have told the Executive what to do. We have told them privately and we have told them publicly. However, on our own part, we must decide on what we need to do.”- Senate President, Dr. Abubakar Bukola Saraki.
“There are a few issues that have come up for discussion:
We have had the address from the Security Chiefs that came here on the issue of coordination to strengthen the nation’s security.”- Senate President, Dr. Abubakar Bukola Saraki.
“We have had the Report from the Senate Security Summit that we need to consider and deal with.
Now, we have the comments from the Deputy Senate President on the issue of State Police.
We have a Bill on Police reform that is due for Second Reading and passage.
We have the Composition of the Police Service Commission, which is listed on today’s Order Paper.”- Senate President, Dr. Abubakar Bukola Saraki.
“These are things that are within our control. Let us play our own part to address the issues that we have control over. On this note, the leadership of the National Assembly will also need to pay a visit to Zamfara State.”- Senate President, Dr. Abubakar Bukola Saraki.
Senate resolved to:
1. Condemn the terrorist attacks, mass killings and displacement of the people and occupation of their central homes and farmlands.
2. Urge the Executive to overhaul the security architecture of the country and to put in place a better security action plan and decisively tackle violent terror attacks threatening the continuous existence of communities in the North Central geopolitical zone and indeed Nigeria.
3. Urge the Executive arm of the government to undertake the rehabilitation of displaced persons and reconstruction of communities in Plateau North, South and Central Senatorial District so they can return to their homes and farmlands.
4. Urge the Executive arm of Government to apprehend and persecute all perpetrators and sponsors of violence, no matter how highly placed they are.
5. The Senate should direct its constitutional review committee to put in machinery to amend the constitution to allow for the creation of State Police.
6. The Senate should as a matter of urgency fast track the passage of the Peace and Reconciliation Bill.
7. Security agencies to stop involving themselves in the politics of the nation.
8. The Senate hereby mandate that the Peace and Reconciliation Bill, Police Reform Bill be passed within the next two weeks and the Constitutional Review Committee within the next two weeks should bring forward the amendment for State and Community Policing.

PRESENTATION OF A REPORT

EXECUTIVE COMMUNICATION
Senate President, Dr. Abubakar Bukola Saraki read an Executive Communication from President Muhammadu Buhari on the 2018 Statutory Budget Proposal for Federal Capital Territory (FCT), Abuja.
Confirmation of Nomination by Senator Ahmad Lawan.
-That the Senate do consider the Request of Mr. President C-n-C on the Confirmation of the Nomination of the following persons for Appointment as Chairman and members of the Police Service Commission (PSC) in compliance with the provision of Sections 153(1) (m) and 154(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended).
1. Musliu Adeola Kunbi Smith CFR, M.Sc, FNIM, fwc- Chairman(South West).
2. Justice Clara Bata Ogunbiyi, (FNICArb) (rtd)-Full-time Commissioner(North East)
3. Lawa Bawa (AIG) Rtd, CON, mni- Full-time Commissioner(North West)
4. Muhammad H. Najatu- Member(North West)
5. Braimoh Adogame Austin- Member(South South)
6. Barr. Rommy Mom- Member(North Central)
7. Dr. Nkemka Oshimiri Jombo-Ofo- Member(South East).
Senate President, Dr. Abubakar Bukola Saraki referred the executive communication to the Committee on Police Affairs to report back in a week.

Senate Leader moved that all other items on the order paper be stood down to another legislative day. Minority Leader seconded.
