APGA Leadership Crisis: Special Appeal Court Panel Sitting At Enugu 15th August 2017.

The police on Tuesday, withdrew its application against the order of mandamus  earlier granted the acting national chairman of the All Progressive Grand Alliance, chief Mratin Agbaso at an Enugu High court 2 presided by justice A.R. Ozoemena.

The order of mandemus restrained the former national chairman, chief Victor Oye from acting as the national chairman of the party, a development his group had been making frantic efforts to set aside.

This followed the adjournment sine die of hearing of the matter by the presiding Judge of the Enugu court of Appeal, Justice Abdu Aboki.

In his withdrawal application, the lawyer to the police, Mr O. J Nnadi(SAN) said, "we filed a motion of Appeal against the Order of Mandamus granted by the lower court. However, we want to withdraw the application."

Earlier the Independent National Electoral Commission, INEC that had aligned itself with the application also joined in the withdrawal as the INEC lawyer Mrs Nkiru simply said, "my lord i have no objection."

The Oye led faction held governorship primaries to affirm governor Willie Obiano as its sole candidate in the November 18, 2017 governorship poll in the state at the women development center, Awka.

Meanwhile, Oye and his national secretary, Labran Maku were at the Enugu court of Appeal.

At the commencement of the matter, the lawyer for Agbaso, Mr Tochukwu Maduka had made an Application for a stay of proceeding on hearing of the matter on grounds that once an Application made at the court of Appeal was before the Supreme court the court of Appeal should adjourn and await the decision of the supreme court.

However, the court rejected the Application and proceeded to hear the matter but adjourned indefinitely.
